THE PROBLEM

Many states have a doctrine called the Corporate Practice of Medicine (CPOM) that prevents non-physicians or non-physician owned practices from receiving payment for medical services. In the Med Spa world, this means the med spa must be owned by a physician or have a physician providing any and all medical procedures, making clinical decisions, and receiving payments for medical treatments. 

At your med-spa, simply having a medical director is not enough. 

Without realizing, your business may be functioning illegally, which could result in fines, loss of licenses, or even criminal charges.
